TAA Compliance: Flex Matrix Series

What is TAA?

The Trade Agreements Act (TAA) is a U.S. federal law (41 U.S.C. § 8301–8305) that requires products purchased by the U.S. federal government to be manufactured or substantially transformed in the United States or a TAA-designated country. TAA compliance is a mandatory procurement requirement for:

  • U.S. federal government agencies (GSA Schedule purchases)
  • Department of Defense (DoD) contracts
  • State and local government entities purchasing under federal cooperative contracts
  • Educational institutions using E-rate or federal funding programs
  • Any organization purchasing through a federal contract vehicle

TAA-Designated Countries

Products manufactured or substantially transformed in any of the following are TAA compliant: United States, most EU member states, Australia, Canada, Japan, South Korea, Taiwan, Switzerland, and other countries with which the U.S. has a qualifying trade agreement. Notably, products manufactured in China are not TAA compliant for U.S. government procurement.

Why TAA Compliance Matters for Your Project

  • GSA Schedule eligibility: TAA-compliant products can be listed on and purchased through the GSA Multiple Award Schedule (MAS) program, the primary procurement vehicle for federal agencies.
  • LPTA and Best Value contracts: TAA compliance is a go/no-go requirement — non-compliant products are disqualified regardless of price or features.
  • State and local government: Many state contracts and cooperative purchasing programs (NASPO, OMNIA, etc.) require TAA compliance even for non-federal buyers.
  • E-rate and federal education funding: Schools and libraries using E-rate funding must purchase TAA-compliant equipment for eligible categories.
