These Terms of Use govern your use of kanexpro.com (the "Website"), which is operated by Kanex Pro ("KanexPro", "we", "us" or "our"). By visiting or using the Website you agree to these terms. If you do not agree to them, do not use the Website.

The Website is a product catalogue and support resource. Nothing is sold on it. Purchases of KanexPro products are made through the KanexPro Store at store.kanexpro.com, which has its own terms of service, or through authorized resellers and distributors under their own terms.

1. Use of the Website

You may use the Website to learn about KanexPro products, find compatibility and specification information, download documentation and firmware for products you own or are evaluating, and contact us. You agree not to:

• use the Website for any unlawful purpose, or in any way that breaches these terms;
• copy, scrape, harvest or extract the Website's content in bulk by automated means, except as a public search engine does in the ordinary course of indexing;
• interfere with the Website's operation, probe or test its security, or attempt to gain access to systems or data that are not offered to you;
• misrepresent your identity or your affiliation with any person or organization, or present the Website's content as your own;
• upload or transmit anything that contains malicious code.

We may restrict or end your access to the Website if you breach these terms.

2. Product Information

We work to keep the Website accurate, but product descriptions, specifications, images, compatibility statements, availability and any prices shown or referred to are provided for information and may contain errors or change without notice. They are not an offer to sell. Before relying on a specification for an installation, confirm it against the product's current manual or datasheet, or ask us. The terms of any purchase, including price, delivery, returns and warranty, are those of the store or reseller you buy from.

3. Downloads

Manuals, datasheets, firmware, drivers, control modules and other files made available on the Website are licensed, not sold, to you for use with KanexPro products. You may not modify, reverse engineer, decompile or disassemble firmware or software except to the extent applicable law expressly permits, and you may not redistribute a download except as the file's own notice allows. Installing firmware is at your own risk; follow the instructions that accompany it.

4. Intellectual Property

The Website and everything on it, including text, photographs, illustrations, diagrams, documentation, software, page design and the arrangement of it all, belong to KanexPro or its licensors and are protected by copyright and other intellectual property laws. KanexPro, Kanex Pro, the KanexPro logo and our product names are trademarks of Kanex Pro. Other names and marks on the Website belong to their owners.

You may view the Website and print or save pages for your own reference. You may not otherwise reproduce, distribute, modify, publicly display or create derivative works from the Website's content, or use our marks, without our prior written consent. Resellers and distributors may use our product images and descriptions only as their agreement with us allows.

5. The Trade Store, Resellers and Third-Party Links

These terms cover this website. They do not govern buying anything. Nothing is sold on this website: it is a manufacturer's site for specifications, documentation and support.

Orders are placed on the KanexPro trade store at b2b.kanexpro.com, which is a separate site with its own terms of service, privacy policy and refund policy. Those terms, not these, apply to an order placed there — including price, payment, shipping, returns and cancellation. Access to the trade store is for approved trade accounts.

The Website also links to sites we do not operate: distributors and resellers, social media, and manufacturers of products ours work with. We are not responsible for the content, accuracy or practices of those sites, and a link is not an endorsement. A purchase from a distributor or reseller is a matter between you and them, on their terms.

6. What You Send Us

If you send us a question, a suggestion, a review or other feedback through the Website, we may use it without restriction or payment, including to improve our products and documentation, and we are not obliged to keep it confidential unless we have agreed to in writing. Personal information you send us is handled as our Privacy Policy describes.

7. Warranty Registration

If you register a product at kanexpro.com/warranty/register, you confirm that the details you give us — the model, the serial number, the date of purchase and the seller — are accurate, and that the receipt or invoice you upload is a genuine record of that purchase.

Registration is a convenience: it means we hold your proof of purchase so that a later warranty claim does not depend on you finding the invoice. It does not create, extend or alter any warranty. Cover, exclusions and remedies are governed solely by the KanexPro Limited Warranty at kanexpro.com/warranty, and a return still requires an RMA or case number obtained in advance.

Registering a product does not by itself establish that a product is covered. We may decline a claim where the details given cannot be verified, where the product was not bought from an authorised KanexPro reseller, or on any other ground set out in the Limited Warranty.

What we do with the information you submit is set out in our Privacy Policy.

8. Privacy

Our Privacy Policy explains what information we collect on the Website, how we use it and the choices you have. It forms part of these terms.

9. Disclaimer of Warranties

The Website and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Website will be uninterrupted, timely, secure or error-free, or that its content is complete or current. This section concerns the Website only. The warranty on a KanexPro product is the product warranty that accompanies it, and is not changed by these terms.

10. Limitation of Liability

To the fullest extent permitted by law, KanexPro and its officers, employees, affiliates, agents and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to your use of or inability to use the Website or its content, however caused and under any theory of liability, even if we have been advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the maximum extent the law allows. Some jurisdictions do not allow some of these exclusions or limitations, so they may not apply to you in full.

11. Indemnification

You agree to indemnify and hold harmless KanexPro and its officers, employees, affiliates, agents and suppliers from any claim, demand or expense, including reasonable attorneys' fees, made by any third party because of your breach of these terms or your violation of any law or the rights of a third party in using the Website.

12. Governing Law

These terms and any dispute arising out of them or your use of the Website are governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law rules.

13. Changes to These Terms

We may update these terms from time to time by posting the revised version on this page with a new "Last updated" date. Your continued use of the Website after a change is your acceptance of the revised terms. If a provision of these terms is found unenforceable, the rest remain in effect.
